Your legal matters deserve experience, expertise and results. Without creative thinking, legal knowledge and commitment, opportunities are lost, cases drag on and find no solution.
Without deep legal knowledge, solutions do not appear. Without practical experience, the rules of the game seem like children’s toys. No opportunity is missed when you know what has to be done.
Mitidiero Advocacia, based in Porto Alegre and with a branch in Brasilia, is led by Daniel Mitidiero, attorney and Professor of Civil Procedure at the Federal University of Rio Grande do Sul (UFRGS). His books are reference in both the study and practice of Law in Brazil. Thousands of judicial decisions — from all courts, especially the Supreme Federal Court (STF) and the Supreme Court of Justice (STJ), the Court of Appeals of Rio Grande do Sul and the Federal Court of the 4th Region — cite his works as basis for their rulings.
Sometimes, the problem lies in the rule of the game. It’s relatively easy to identify that a case involves a dispute between business partners, the interpretation of contracts, liability for personal or environmental damage, construction in permitted or restricted areas, undue taxation, probate proceedings, or unpaid expropriations, and so on.
What’s a bit more difficult is to recognize that each of these issues must be litigated through specific legal instruments, whose sophistication requires both experience and expertise.
How do I obtain an urgent court order? Do strong written submissions and persuasive oral arguments in an appeal to the Court of Appeals or the Federal Court of Appeals make a difference in winning a case?
How do I file a special appeal capable of turning the tide at the Superior Court of Justice? Or an extraordinary appeal before the Supreme Federal Court? How can I ensure the success of an enforcement proceeding?
How should I respond to an unjust enforcement action? What is the purpose of a rescisory action? How can I defend myself against one? Mastering the rules of the game changes the game.
